Online Concrete Cutting Services Pty Limited – Terms and Conditions
PRICE
All prices quoted shall be valid for thirty (30) days. Written confirmation from Online Concrete Cutting Services Pty Limited (herein after referred to as OCCS) is required for validity to be extended beyond thirty (30) days.
All prices are based on the cutting (sawing) of normal brickwork or concrete with normal bluestone aggregate, as determined by OCCS.
EXCESS STEEL (DRILLING) – Unless otherwise arranged the drilling rates allow for 1 x 12mm re bar per hole. Should a higher concentration of reinforcement be present the client shall be charged at the current rates applicable.
Price lists are subject to change without notice. Errors and omissions accepted (E&OE).
COMMENCEMENT AND COMPLETION
OCCS undertakes to use every reasonable effort to comply with the Commencement and Completion times quoted.
In the event that the works to be carried out by OCCS are delayed due to circumstances beyond our control then a fair and reasonable extension of time for the completion of the work shall be given by the client.
TIME
All work shall be carried out during normal working hours (Monday to Friday 7:00am to 3:30pm) unless otherwise stated or arranged.
Unless otherwise stated, any overtime shall be treated as an extra cost and the client shall be charged accordingly.
High rise (over three (3) levels above ground) – the client is to arrange appropriate access to elevators and/or crane, or provide labour to carry equipment to required floor / level.
SITE
The client shall ensure that the job site is cleared of material, tools and tackle and any other such obstacles that may hinder the proper and continued performance of the works as per Occupational Health and Safety regulations on the day.
Where the job site is in such a condition as to make it necessary for OCCS to attend to the cleaning before or during the execution of the work, the client shall be charged for such labour costs as per current rates prevalent at the time the work is performed.
MARKING OUT
Unless otherwise agreed it shall be the client’s responsibility to clearly mark out in waterproof crayon the work that is to be carried out by OCCS.
It is the client’s responsibility to ascertain the location of the services and to clearly mark services which may be situated within the working area such as Telephone, Electricity, Water and Gas.
The client is responsible for calling DIAL BEFORE YOU DIG, on phone number 1100.
OCCS shall not be liable for any damage caused to any person, building, structure, service, fitting, fixture, goods or chattels, nor shall OCCS be liable for any damage caused by failure or delay due to strikes, lock-outs, accidents, labour shortage, fire, flood or other casualty or shortages or failure of fuel, power, break-down of equipment or events of an unusual nature which may cause interruption to the work.
OCCS will not, under any circumstances whatsoever be liable for consequential losses or damages resulting from or arising out of the carrying out of work for the client.
VERBAL INSTRUCTIONS AT SITE
Any verbal order for the additional work given by any representative of the client to OCCS (or its representative) on site shall be deemed to have been ordered by the client and the client shall be charged for such work at the rates current at the time.
MEASUREMENT OF WORKS
At the completion of the works the client or representative of the client shall be in attendance and the works shall then be duly measured. Should neither the client or a representative of the client be present at such time, OCCS shall carry out the necessary measurement and forward such calculations to the client where, if the client does not object within seven (7) days of receipt of same, such measurements shall be deemed to be conclusive of the work carried out.
MAINS PRESSURE AND ELECTRICITY
Mains water pressure and electricity shall be made available within 50 metres and 20 metres respectively.
Where OCCS is requested to supply electricity or water, the client shall be charged at the current rates as agreed before commencement on site.
TRADING TERMS
Unless otherwise stated, payment is required on completion of work.
Where credit has been provided, an account becomes overdue if not paid by the date due as outlined on the job docket and/or the invoice. Overdue accounts will incur interest at the rate of 12 per cent per annum and an overdue charge of $55 per month overdue may apply.
If you fail to pay any invoice by its due date, OCCS may, without prejudice to any other remedy, cease any part or all work until the payment is made, in which case the amount shall be increased by the amount of the costs and expenses incurred by OCCS as a result of the cessation and the subsequent resumption of work.
By engaging OCCS to perform work, and thereby providing OCCS with certain personal information, the client is taken to have read and understood OCCS’s Privacy Policy. Further to this, in accordance with the relevant Privacy Laws: (i)
The client agrees that OCCS may obtain a credit report containing information about the client from a credit reporting agency for the purposes of assessing any application for credit; (ii)
The client agrees that OCCS may exchange information with credit providers and credit reporting agencies to assess an application by the client for credit; notify other credit providers of a default by the client; and to assess the client’s credit worthiness; (iii)
The client understands that this information can include any information about the clients credit worthiness, credit standing, credit history, credit capacity that credit providers are allowed to exchange pursuant to privacy laws in force at the time.
GENERAL TERMS
OCCS shall have no liability, howsoever arising, for damages in respect of loss of profits or contracts or for indirect or consequential loss or damage or for loss or damage arising out of or in connection with any work performed.
Failure by either party to enforce a provision of these terms shall not be construed as in any way affecting the enforceability of that provision or any other terms and conditions outlined herein.
These terms and conditions are governed by and construed in accordance with the laws of the State of New South Wales.
Part or all of any clause of these terms and conditions that is unenforceable or illegal will be severed from the terms and conditions and will not affect the enforceability of the remaining provisions of these terms and conditions.
